Part 1 of 2 - What to Do During an IRS Audit – The Do’s and Don’ts

It's Never Too Late -
Call NOW
678-366-9232
An IRS audit can be stressful. Consider this article a bit of IRS assistance, a bit of wisdom to help you out if your business is experiencing an audit. There is a lot of complexity when it comes to laws and polices relating to an IRS audit, and most business owners frankly are just too busy to go out and understand them all while still running a business trying to make an honest buck. If you find yourself in that camp, you may want to just skip this article and go hire some IRS representation right now. It will save you a lot of time and headache, a good place to call is GBC Atlanta Income Services if you are finding yourself in the midst of an IRS audit and you just do not have the time to take care of it all by yourself. With that said, let us get into what you SHOULD do and what you SHOULD NOT do when you are running into some possible IRS trouble!
  • All employees should be instructed not to talk to the IRS agent if the audit takes place at your place of business.
  • 10 Days prior to the interview with the agent send him or her a formal letter stating you will be recording an audio of the interview. A special note to avid camera people, videos are not allowed.
  • If the IRS audit brings up things you do not have the knowledge of, immediately seek out a CPA (certified public accountant) or attorney.
  • Only give files to an IRS agent that is actually related to the IRS inquiry. By volunteering files or records, you may open up a whole new can of worms you would rather not have to deal with.
  • Get a thorough understanding of your tax returns and then organize the files that support the items questioned by the IRS audit.
  • Before the examination, come up with various settlements that you are comfortable accepting so you have backup plans to work with incase of any lingering IRS trouble.
  • Do not be afraid to seek out good IRS representation, as this can save you a lot of time and money.
Use these tips to fit your own business accordingly. It should be noted that there are a few penalties that can be transpired against your business depending on the outcome of the IRS audit. Some of these are pretty brutal. Because of these penalties, it is imperative you either understand what you are doing thoroughly or hire good IRS representation that does understand what they are doing.

Next month we will cover some of the penalties you will face due to an IRS audit.

Part 1 of 2 - Why Having Proper Tax Records Now Will Save You Big on an IRS Audit Later

KEEP YOUR RECORDS STRAIGHT
No one likes an audit, especially an IRS audit. However, getting an IRS audit is only a matter of time, more of a question of when rather than If, so you should be prepared. The best way you can possibly prepare for an IRS audit for your Atlanta business (or any business for that matter) is by doing one very simple task.

Keep your tax records straight! Make sure everything is filed away right! For people who are reading this and are the proud owners of messy offices and come equipped with office paper with a little bit of desk underneath, this simple task may seem overwhelming large for you right now. The keyword of course is- right now.

By doing this, you ensure yourself the greatest chance of avoiding any IRS trouble that may be in your future. Sure, it might seem like a major hassle right now, but you will thank your past self for their amazing foresight when it comes time for your inevitable IRS audit. The great thing is once you do this once, get all your records straight, and use your shovel (or forklift loader depending on your situation) to remove all those papers and records from your desk into actual systematic filings, it is going be easy sailing from here on out.

Once the first big mess is done and filed, you can make a routine of doing it. Once it becomes habit, keeping your tax records up to date and accurate will be a simple job that will only take a few minutes for you to do. The important thing is to do it now.

Next month we will cover some of the things you want to look for and file correctly to avoid any IRS trouble.

Part 1 of 2 - The IRS Audit Monster – What Are the Chances of You Running into the Beast?

Don't let the IRS audit monster
get you down!
An IRS audit truly is like a monster for some business owners and entrepreneurs. Why would it not be? Here you have a huge headache, and if you are like many business owners, you are probably unsure what you need to have all in order to make it out of the beast’s den unscathed. As with most business owners, you probably also think that the chance of the IRS audit monster visiting you is extremely unlikely. Well, you may want to think again.

After all, the IRS in the U.S. has increased the number of IRS audits by a whopping and terrifying 37% since 2001. That is a gigantic increase! Hold on, no need to stop reading and start rushing to file all your paperwork all professionally just yet. There are some silver linings here that may be good news to you. While the IRS audits have grown vastly since 2001, most people getting them and experiencing real IRS trouble are people who have abusive tax shelters and corporations. The other thing that an IRS audit looks for in its prey is people who are high income taxpayers – typically making over a $100,000 a year.

That does not mean an IRS audit cannot come flinging at your place of business though. As with any good monster, there are hexes you can use and wards you can manifest to keep it at bay. In other words, you can do certain things and make your business more efficient to help avoid any IRS trouble in the first place. One of the best things you can do is making sure all your records and filings are correct and properly organized.

Next month we will cover how juicy of a target you are for an IRS audit with additional info tips.

Why Payroll Taxes are About to Get Harder to Manage

We keep your business healthy
despite the Affordable Care Act
Times are tough, and times are a-changing. Unfortunately, a lot of the changes going on right now is going to make it harder on business owners rather than easier.

In a weak economy, even governments are hungry for money (well, more than usual). With all of these changes rolling out, the business owner is going to have a lot of things to keep track of – not to mention still being focused on making money for their business.

One area of business life that is going to get harder is the payroll tax and W1 compliance becoming more difficult to manage.

This is happening because:
  • Due to Affordable Care Act of 2010
  • The ever changing guidelines coming from the IRS and HHS (Health and Human Services)
  • The potential possibility of additional stimulus measures

Why take the risk?

You got better things to do than to pull out your hair wondering what the new guidelines from the HHS is going to mean for your business and how to comply with it. Instead, outsource it, take a sigh of relief, and get back to doing what you do best – turning a profit.

Part 1 of 3 – 9 Ways To Maximize Your Business’ Revenue By Outsourcing Payroll

We are Your BEST
Business Solution
If you are running a business, you can basically divide all of your responsibilities into two categories: those that are directly connected to bringing in revenue, and those that are not. If you have a staff, you need to take care of payroll, but clearly this is not directly making you a profit. Therefore, it is nice to have someone else thinking about that responsibility. But does that mean you should outsource it? It may be a great way to free up your staff for money making projects.

So what are the benefits of outsourcing your payroll to a professional service? Consider these:
  • More time to focus on other activities
  • You don't need to hire an in-house professional
  • A dedicated payroll company may save you money
Just think – if you have in-house accountant, they won't just be running payroll. Having multiple responsibilities can lead to more frequent errors. A dedicated payroll service, however, is just focused on getting your checks out on schedule and accurately. The amount the service costs may actually be less than the price of in-house manpower combined with supplies and software for printing and mailing checks.

Next month we will cover more benefits of outsourcing to a professional payroll services company.

Finding the right IRS Representation in Atlanta Georgia

Find the Best Atlanta
IRS Representative at GBC
Taxes can be complicated, frustrating, and leave you a wreck for days, but just imagine you find out you are going to get a visit from the tax man or that something was wrong with what you sent in. Now the real panic sets in!

In order to hire the right person, you need to know what a tax rep can do for you. Things to look for when searching for experience Internal Revenue Service Representation.

It's time for you to find the right IRS tax representation for your Georgia taxes.

First of all, if you owe outstanding taxes, your representation should be able to help you reach a reasonable compromise. What questions will they consider to help find a middle ground between you and the IRS?
  • Is the amount of tax being required the correct amount?
  • Could you ever conceivably pay the tax owed?
  • If the answer to both is affirmative – would paying back the outstanding debt place you under extreme financial burden.
  • Visit the IRS website.

Since the government rejects the great majority of attempts at compromise, be certain to find representation that will pre-qualify the request. That way you are not wasting your time and even more money getting together the needed information to present your case. Which income tax documents and forms are needed?
  • Form 433-A Collection Information Statement for Wage Earners or Self-Employed Individuals
  • Form 433-B Collection Information Statement for Businesses
  • Form 656 Offer in Compromise
  • Visit the IRS website.

Of course depending on whether you are self employed or are running a small business that will determine which of the first two forms you will use.

Another sticky Internal Revenue Service situation arises when you can't pay your taxes on time in full. Does the government offer payment plans? While it isn't generally advertised, a representative can help you to set up a reasonable monthly plan. Look for someone who can:
  • Help with Form 9465 which is a request for a payment plan
  • Help you avoid interest and late fees by encouraging you to scrounge up as much as you can for the initial payment
  • Contact you immediately when they hear back from the IRS regarding whether your request was accepted or denied, or if you need to provide additional information
  • Visit the IRS website.

Your tax representation also needs to have a good grasp on penalties. Do they know the penalties for:
  • Failure to pay
  • Inaccurate filing
  • Understatement of the amount due
  • Late filing
  • Fraud
  • A frivolous return (not enough information to verify tax amount due)

There are many situations in which you would need Atlanta IRS tax representation.
Be sure to find someone who has experience in the aspect of tax law that you need assistance. Since you probably don't want to flash around problems with the IRS, the best way to find your representation is online. But if you happen to know someone who has had a problem in the past, word of mouth usually makes for good recommendations.

Tips for How Businesses can Handle Payroll Tax Troubles With The Internal Revenue Service

Steer Clear of Misfiling
Payroll Taxes
It is not a mistake that the majority of small businesses in Atlanta Georgia with payroll tax troubles are seeking IRS representation.

Why? Because the Internal Revenue Service can be a real bull dog when it comes to collecting this tax. In many ways, it is the most serious tax of all.

As a business owner, it makes sense for you to become more knowledgeable on how to deal with your own payroll tax issues. Once you understand what to do and why to do it, that is when you can steer clear of heft damages caused by misfiling your payroll taxes with the IRS.

Also, it means less money you may need to spend on Atlanta IRS representation! (Or hiring a firm for audit help).

The easiest way to stay out of trouble is by using a bonded payroll tax service to both file and make all payroll tax deposits. This helps cover you in case there is an issue. Also if you can only make partial payments, it is very important to write on the check that your contribution should go to  the trust fund portion of the tax. Along with writing it on the check, enclose a letter stating you have designated the funds to the trust fund portion of the IRS payroll taxes.

The trust fund portion of Atlanta IRS payroll taxes consist of:
  • Employee's income
  • FICA contributions
The smaller part is the employer's share of the FICA contribution, which is not subject to the actual Trust Fund Recovery Penalty. While this reduces what the Internal Revenue Service can assess against your business by only an 8%, it is important to stack the odds in your favor and every little bit helps.

Don't let your small Atlanta based business be overcome by problems with the IRS.  Call GBC IRS Income Tax Representatives today (678-366-9232) for all your income tax needs and representation.

GBC Tax Services founder is Ghassan R. Ghraizi, CPA, CGMA.  Ghassan is a Certified Public Accountant, Certified Chartered Global Management Accountant, Atlanta BBB Member.

Do you need to meet with your tax representation prior to being audited by the IRS?

Having excellent experienced tax
representation is extremely
 important and invaluable
during an audit by the IRS.
People who acquire tax representation for their tax audits, often wonder whether or not they need to meet with their actual tax representative.

The good news is that if your time is extremely valuable and you hire tax representation to represent you to the IRS, you usually do not need to meet up with them at all.

Through the Power of Attorney (form 2848), your tax representative can handle all the dealings with the IRS on their own. This includes even being able to sign final agreements with them after the tax audit of your business is complete.

One thing to note is that tax representation can be extremely useful for people who are incredibly busy, however there is a caveat that needs to be talked about. The IRS can still force you to appear by using what is called an “administrative summons”. This administrative summons is most often used if your IRS representative is not cooperating with the IRS and sharing all the details they are looking for. Often this happens too if they are expecting or have suspicions of some sort of fraudulent behavior with your filing.

In this case, having very good tax representation is extremely important and invaluable. They can help you save yourself from possible pending criminal charges which the IRS take extremely serious. If you do know you filed wrongly, or inaccurately, you should hire help right away to help you correct the mistake.

Often people in this situation succumb to:
  • Fabricating receipts
  • Fabricating records to support invalid deductions
  • Lie to the examiner about income or other items

High quality tax representation whether you are in Atlanta, Georgia or anywhere else is money well spent and is often worth its weight in gold (solid gold).

Typically, it is very difficult for the IRS to prove underlying tax evasion. Doing any of the above three things though is what on average leads to the taxpayers ultimate downfall. Honesty truly is the best policy. Regardless, having a good tax representative who is well versed in criminal cases or potentially criminal cases could end up saving you from the wrath of the IRS.

Bad Tax Preparer:
Lies About Tax Breaks
Warning Signs of the Bad Atlanta Georgia Income Tax Preparer:

WARNING SIGN 4

The Big Lie About the Ethnic Tax Breaks...

Anyone that tells you that you get a tax break based off your race or religion, is an idiot or a scammer. Since even idiots know we are all taxed more or less the same, you can bet that this person is a scammer and you need to stay away from this person.

For example in the last 10 years or so, there has been a scam running targeting African Americans stating they get tax breaks due to slave era reparations. This is just absolutely false, and if you get sold some of this snake oil, you know it is time to run away before you get hurt and lose some serious money.

Atlanta Payroll Tax Problems with the IRS? No Worries. We Got You Covered.

Haste makes waste
If you are in Atlanta and are having payroll tax problems with the IRS, fear not anymore. There is indeed a solution. There is a few things you should know about payroll taxes though, crucial knowledge that could help you avoid legitimate problems with the IRS as long as these rules of thumbs are followed and guidelines applied.

First things you need to know before getting Atlanta IRS representation is what to hold back from every employee's paycheck:
  • Federal (and if applicable state) income taxes
  • FICA contributions (for such programs as Social Security and Medicare)
  • READ MORE ABOUT FICA
Knowing that going in, it will be a whole lot easier to help you out of your Atlanta IRS based problems should you ever need professional audit help.

Other important notes for an employer to know to help them with their Atlanta payroll tax problems:
  • How much income tax to withhold depends on the numbers of exemptions claimed by the employee.
  • FICA contributions from a percentage of gross earnings earned by the actual employee in which you must either match to a certain percentage, or fully.
  • Use a federal tax deposit form with your payment (makes things way easier)
Along with these, there are also a couple things you must make sure you always send to the IRS. If you do not send these to the IRS, then you may indeed find yourself needing Atlanta IRS representation.  The Atlanta IRS requires this information by federal law, so it is best to make sure you send it over:
  • Form 941 Employer's Quarterly Federal Tax Return. Form is filed every 3 months whilst your business maintains employees. This report shows the employees' federal income tax and FICA withheld for the previous quarter.
    Download Form 941
  • Form 940 Employer's Annual Federal Unemployment Tax Return or FUTA. Filed once a year, and is used to calculate federal unemployment tax. It is important to note that the FUTA tax is paid by the actual business and is not withed from the employee's check.
    Download Form 940
If you find yourself failing in this area of Atlanta IRS representation for your business, do not fret. The Atlanta IRS has reported that the vast majority of businesses are often late, or mess up, their taxes. While the Atlanta IRS considers payroll taxes the most serious of all the tax debts, often they will be willing to work with you as long as you pick the correct Atlanta IRS representation.

Be careful with payroll taxes, as Atlanta IRS collectors can be extremely tenacious if you owe any payroll taxes whatsoever.

What can you do in such a crisis?
In order to hire the right person, you need to know what a tax rep can do for you. Here are some things to look for when searching for experience Internal Revenue Service Representation:
First of all, if you owe outstanding Georgia taxes, your representation should be able to help you reach a reasonable compromise.
